1About these Terms
These Terms of Use and Disclaimer (“Terms”) govern your access to and use of the Vijaylaxmi Structural Suite and its tools, including the M1 Isolated Footing tool, together with the website at mandiraengineering.com (collectively, the “Service”).
The Service is owned and operated by Mandira Engineering, a sole proprietorship owned and operated by Nijroop Reddy, based in Kalaburagi, Karnataka, India (“Mandira Engineering”, “we”, “us”, or “our”).
By creating an account, logging in, or otherwise using the Service, you (“you”, the “User”) confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, do not use the Service.
2Who may use the Service
The Service is intended solely for use by, or under the direct supervision of, a qualified and, where required by law, licensed structural or civil engineer who is competent to design, review, and take professional responsibility for the structures concerned.
By using the Service you represent that you possess the necessary qualifications, training, and competence to interpret, check, and apply its outputs, and that you understand the relevant Indian Standard (IS) codes and applicable design principles. The Service is not intended for, and must not be relied upon by, persons who lack this competence.
3Nature of the Service — a design aid
The Service is a computational design aid. It performs calculations and produces outputs to assist a competent engineer in the design process. It is a tool, in the same way a calculator, spreadsheet, or reference handbook is a tool.
The Service does not:
- exercise engineering judgement, make design decisions, or select inputs on your behalf;
- act as, or replace, the engineer of record for any structure or project;
- guarantee that any output is correct, complete, code-compliant, or suitable for any particular structure, site, or purpose;
- account for site-specific conditions, loads, materials, or constraints that you have not correctly entered or that the tool does not model.
The accuracy and appropriateness of any result depends entirely on the correctness of the inputs you provide and on your competent interpretation of the output.
4Your responsibility as the engineer of record
This is the most important clause in these Terms.
You — the engineer using the Service — retain sole and complete professional responsibility for any design, calculation, drawing, or structure to which the Service’s outputs contribute. The engineer of record’s responsibility is not reduced, shared, or transferred in any way by the use of this Service.
You are solely responsible for independently reviewing, checking, and verifying every output of the Service against the applicable codes, standards, and sound engineering principles before relying on it or incorporating it into any design or construction. Outputs from the Service must never be used as a final design without such independent verification.
Report metadata entered by you — including document status (such as Draft, For Approval, or For Construction), revision, firm or company name, client name, and the names appearing as Prepared by, Checked by, or Approved by — is a declaration of you or your firm as the issuing party, not of Mandira Engineering. Mandira Engineering does not review, approve, certify, or assume responsibility for any design or for the issuance of any document generated using the Service.
5Verify before use; codes and standards
The Service aims to implement relevant provisions of Indian Standard codes (such as IS 456, IS 1893, and related standards) to the best of our ability. However:
- Codes are periodically amended, revised, or superseded, and the Service may not reflect the latest version at any given time;
- The official, published IS codes are the authoritative source — not the Service. Where the Service and an official code differ, the official code prevails, and you must follow it;
- You are responsible for confirming that the code provisions, load combinations, factors, and assumptions used are correct, current, and appropriate for your project.
You must independently verify all results against the official codes and your own calculations before use. Reliance on the Service without such verification is entirely at your own risk.
6No warranty
The Service is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we make no warranties, conditions, or representations of any kind, whether express or implied, regarding the Service, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, reliability, or non-infringement.
We do not warrant that the Service will be uninterrupted, error-free, secure, or that any defects will be corrected, or that the outputs will be accurate or complete.
7Limitation of liability
To the fullest extent permitted by applicable law, Mandira Engineering (and its proprietor) shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, goodwill, or for any structural failure, defect, damage, injury, loss, claim, or cost of any kind arising out of or in connection with your use of, or inability to use, the Service or any reliance on its outputs.
Without limiting the engineer-of-record responsibility set out in Clause 4, our total aggregate liability arising out of or in connection with the Service, whether in contract, tort (including negligence), or otherwise, shall in no event exceed the total amount of subscription fees actually paid by you to us for the Service in the twelve (12) months immediately preceding the event giving rise to the claim.
Nothing in these Terms excludes or limits any liability that cannot lawfully be excluded or limited under applicable Indian law.
8Licence and acceptable use
Subject to these Terms and to payment of the applicable fees, we grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Service for your own professional engineering work.
Your account and login credentials are personal to you. You agree that you will:
- keep your credentials confidential and not share, sell, or transfer your account or login to any other person;
- not permit multiple individuals to use a single subscription;
- not copy, reproduce, redistribute, resell, sub-license, create derivative works from, reverse-engineer, decompile, scrape, or attempt to extract the underlying source code, algorithms, or calculation engine of the Service;
- not use the Service for any unlawful purpose or in any way that could damage, disable, or impair it.
We may suspend or terminate access for breach of this clause.
9Subscription, fees, and payment
Access to the M1 Isolated Footing tool is offered on a subscription basis at ₹299 per month (or such other price as we may publish from time to time), billed monthly. Introductory or promotional offers, where made available, apply only as and for the period stated.
Fees are payable in advance. Unless required by law or expressly stated otherwise, fees are non-refundable. You may cancel your subscription at any time; cancellation stops future billing and your access continues until the end of the period already paid for. We may change pricing for future billing periods on reasonable notice.
10Indemnity
You agree to indemnify and hold harmless Mandira Engineering and its proprietor from and against any claims, demands, liabilities, losses, damages, costs, and expenses (including reasonable legal fees) arising out of or in connection with: (a) your use of the Service; (b) any design, calculation, or structure to which the Service’s outputs contributed; (c) your breach of these Terms; or (d) your violation of any applicable law or the rights of any third party.
11Intellectual property
The Service, including its software, calculation engine, report formats, drawings and outputs, design, text, graphics, branding, and the names “Mandira Engineering” and “Vijaylaxmi Structural Suite”, is owned by Mandira Engineering and is protected by applicable intellectual-property laws, including the Copyright Act, 1957. These Terms grant you a licence to use the Service; they do not transfer any ownership rights to you. All rights not expressly granted to you are reserved by Mandira Engineering.
12Suspension and termination
We may suspend or terminate your access to the Service at any time if you breach these Terms, if required by law, or if we discontinue the Service. You may stop using the Service and cancel your subscription at any time. Clauses relating to disclaimer, limitation of liability, indemnity, intellectual property, and governing law survive termination.
13Changes to these Terms
We may update these Terms from time to time. The current version will always be available on this page, with the “Last updated” date shown above. Your continued use of the Service after any change takes effect constitutes acceptance of the revised Terms. We encourage you to review this page periodically.
14Governing law and jurisdiction
These Terms are governed by and construed in accordance with the laws of India. Any dispute arising out of or in connection with these Terms or the Service shall be subject to the exclusive jurisdiction of the courts at Kalaburagi, Karnataka, India.
